iPod battery failure claim form

3gbatteryclaim.jpg
In the mail yesterday I received my "Notice of pendency and proposed settlement of class action" from the Apple iPod Claims Administrator. If they settle the lawsuit and you own a 3G iPod with the defined battery failure, you can choose between sending in your iPod and having it and/or the battery replaced, or receiving a $50 Apple store credit. These benefits seem rather generous to me, usually in these types of class action suits you get some sort of token check in the mail, like $7 or something. I actually spent a little bit of time to read through the paperwork and noticed this bit in section IV that is pertinent - they define battery failure for a 3G iPod as play time of four hours or less, and 5 hours or less for 1G or 2G iPod. Now I just have to find my receipt for Steve the iPod.

Hey i got the claim form too the other day i was wondering if you know if apple is actually going to give you a new battery or will they just give you money off of one. email me if you have the answer.

In response to the above comment; the deal is (according to the form) that Apple will replace your battery or your iPod (which I hope they do, ‘cause it’d be easier on everyone, and totally awesome) at no charge. Shipping and handling charges will be issued, though.

Does anybody know if Apple will send you a new Ipod (4G) or just replace it with a refurb 3G?

I sent my claim in four months ago (aug 5th) and still have heard nothing. I tried to call the claims admin and got nowhere. Is Apple trying to avoid us?? Not very good public immage I think.

unfortunetly my iPod battery started failing way before the class action stuff was in the works. and even now I hear that you have to $30 to send in your iPod so that they will replace the battery. I just bought a replacement battery at http://www.laptopsforless.com/mp3playerbattery/apple-ipod-Battery and it works great.
